Terms of Service

These Terms cover your use of HEALTHCUBED. Please read them alongside our Privacy Policy. The most important thing to know up front: HEALTHCUBED is a wellness tool, not medical advice.

01Acceptance of these terms

These Terms of Service ("Terms") are an agreement between you and HealthCubed, a product of Moreland Accord ("HealthCubed," "we," or "us"). By creating an account or using the HealthCubed app or website (the "Service"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

02The Service is not medical advice

HealthCubed is a wellness and informational tool. Its scores, insights, trends, and assistant responses are for general informational purposes only and are not medical advice, diagnosis, or treatment. They are not a substitute for the judgment of a qualified healthcare professional.

Always seek the advice of your physician or another qualified provider with any questions about your health, and never disregard professional advice or delay seeking it because of something you read or saw in the Service. Do not use the Service for emergencies; in an emergency, call your local emergency number. You are solely responsible for decisions you make about your health.

03Eligibility and your account

You must be at least 16 years old to use the Service. You are responsible for keeping your account credentials secure and for activity under your account. Tell us promptly if you suspect unauthorized use. The information you provide must be accurate and kept up to date.

04Acceptable use

You agree not to misuse the Service. In particular, you will not:

  • Break the law or infringe anyone's rights while using the Service.
  • Attempt to access accounts, data, or systems that are not yours.
  • Interfere with, disrupt, probe, or overload the Service or its infrastructure.
  • Reverse engineer, scrape, or copy the Service except as the law expressly permits.
  • Use the Service to build a competing product or to resell it without our permission.

05Your content

You keep ownership of the content you create in the Service, such as journal entries, logs, and messages. You grant us a limited license to store, process, and display that content solely to operate the Service for you, as described in our Privacy Policy. You are responsible for the content you provide and confirm you have the right to provide it.

06Our intellectual property

The Service, including its software, design, models, and brand, is owned by us and our licensors and is protected by law. We grant you a personal, limited, non-transferable, revocable license to use the Service for your own personal, non-commercial use, subject to these Terms. All rights not expressly granted are reserved.

07Third-party services

The Service works with third parties, such as Apple Health and the infrastructure and AI providers described in our Privacy Policy. Your use of those services may be subject to their own terms, and we are not responsible for third-party services we do not control.

08Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any score, insight, or result will be accurate or suitable for any purpose. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

09Limitation of liability

To the fullest extent permitted by law, HealthCubed and Moreland Accord, and our affiliates, officers, employees, and agents, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or health outcomes, arising out of or relating to your use of, or inability to use, the Service, even if we were advised of the possibility. To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim or one hundred U.S. dollars. Some jurisdictions do not allow these limits, so they may not fully apply to you.

10Indemnification

You agree to indemnify and hold harmless HealthCubed and Moreland Accord from claims, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Service or your violation of these Terms or of applicable law.

11Termination

You may stop using the Service and delete your account at any time. We may suspend or end your access if you violate these Terms or if we need to for legal, security, or operational reasons. Sections that by their nature should survive termination will survive.

12Changes to the Service and these Terms

We may change the Service or these Terms over time. When we make material changes to the Terms, we will update the effective date above and, where appropriate, notify you. Your continued use after a change means you accept the updated Terms.

13Governing law and contact

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules. The courts located in Texas will have jurisdiction over disputes, except where mandatory local law provides otherwise.
